Terms And Conditions
A client shall be obliged to adhere to the Standard Terms and Conditions for service as expressed hereunder.
Unless otherwise agreed in writing, these terms [Terms and each Term] and HostessandCook purchase order(s) [Order or Orders] represent the only conditions upon which HostessandCook procures services [the Services] specified in the Order from the person to whom the Order is addressed. HostessandCook does not accept any other conditions, which the Client may specify, unless otherwise agreed to by HostessandCook in writing. In the event of any inconsistency between these Terms and any Order, these Terms shall take precedence.
1. Conformity With Order
Services shall conform strictly with the Order. The Client shall not vary the quantities specified and/or the specification, if any, stipulated in the Order, without the prior written consent of HostessandCook . A minimum of 2 working days is required for all orders unless otherwise agreed in writing.
2. Delivery and Title
The delivery dates and addresses are those in the Order. Time shall be of the essence in respect of the client and HostessandCook obligations under the Order.
HostessandCook will not be excused for delay in delivery or performance except due to circumstances outside its control and then only subject to the HostessandCook having notified a client in writing on becoming aware of such circumstances. HostessandCook may terminate an Order, in whole or in part, without incurring any liability.
Risk of loss or damage to Goods shall pass to the client on delivery, and title shall pass to the client when payment to the HostessandCook has been effected.
If on delivery, the service do not conform to the Order, a client may reject the Services and HostessandCook shall promptly rectify any defects.
3. Price and Payment
Prices specified in an Order are subject to change. A non-refundable deposit of 60% is required to confirm booking at HostessandCook and balance must be paid prior or on the date of delivery. No delivery shall place before outstanding balance has been settled in full.
Payment shall be made by client in the South African currency and on the terms stated in the Order. Payment can be made in cash, via EFT, via Ewallet, via cash-send with a proper reference number and details of the client. No payment shall be regarded valid until HostessandCook have received cleared funds. Any amounts due in terms of these Terms shall be paid to the HostessandCook, taking into account any deduction or set-off and bank charges.
4. Termination of Order
Hostess and Cook may cancel an Order in whole or in part at any time upon at any time with written notice to the client, when the client commits any serious breach or any repeated or continued material breach of its obligations under these Terms and/or Order or shall have been guilty of conduct tending to bring Hostess and cook into disrepute.
In the event of termination Hostess and cook must submit all claims to the client and client must pay the amount claimed within 7 days. Only order amendments or cancellations which are given at least 7 working days before the intended delivery date will be accepted otherwise the client will have to pay full amount of the order. Orders placed or cancelled on weekends (Saturday or Sunday) or Public Holidays will be treated as having been received on the following working day.
Notices under these Terms shall be delivered by hand to the relevant addresses of the parties in the Order or may be served by facsimile or by email, in which event notice shall be deemed served on acknowledgement of receipt by the recipient.
Our basic ingredients include sugar, eggs, flour, dairy products; butter and\or may contain traces of nuts. If you wish to enquire ingredients before placing an order please email us firstname.lastname@example.org. Allergens (nuts, milk, gluten, wheat, soya) may be present in our products unless otherwise stated. For diet requirements please mention them on the booking form.
We advise that you store HostessandCook baked goodies in the packaging provided in or clients may transfer baked products into an air tight container and keep in a cool room and DO NOT place in the fridge or freezer, unless advised otherwise. Where clients refrigerate our baked goodies, it is advised that clients let the goodies thaw (until they become to room temperature) for at least an hour or two hours before consuming.
Completion or termination of an Order shall be without prejudice to any Term herein which by its nature would be deemed to continue after completion or termination.
Headings are included herein for convenience only. If any Term herein be held illegal or unenforceable, the validity or enforceability of the remaining Terms shall not be affected.
All rights and remedies available to either party under these Terms shall be in addition to, not to the exclusion of, rights otherwise available at law.
